不知名疯子写道：2024年1月26日星期五，陪审团裁定著名纹身艺术家Kat Von D（真名Katherine von Drachenberg）在一起有关使用Miles Davis照片的版权诉讼中胜诉，因为她使用该照片并未侵犯版权。
这张照片的摄影师Jeffrey Sedlik在2021年2月起诉Von D，声称她以该照片为基础为朋友纹了一副纹身。
Kat Von D在2017年为了送给朋友一份礼物，在她朋友的手臂上纹了这副纹身。
陪审团裁定该纹身并非“高度相似”于该照片，并且还被说服认为该作品的非商业性质意味着她对该照片的使用属于合理使用。
判断艺术品是否侵犯版权并非一件简单的事情，需要结合其创作背景、使用目的以及市场价值等因素进行综合考量。
